FLEP source code is distributed under GNU General Public License. Hence, FLEP is completely free, open and copylefted software.

Note that by the nature of this program (low-level binary modifying), there is a possibility of creating cracks, NO-CD patches and other software modifications, which may break some copyright laws. But, since FLEP itself isn't related to any specific application patching, it can't be considered as a "hack tool", malicious or "virus" software. If you say it, hacking is done with other tools, and FLEP is the one that only applying changes.
